CONFLICT RESOLUTION IN THE ANGOLAN MINING SECTOR THROUGH THE ARBITRATION COURT AS A MECHANISM TO ATTRACTING INVESTORS
Main Article Content
Abstract
This article addresses the need to resort to arbitration as a way to attract more investors to Angola, focusing on the mining sector, which is one of the pillars of the country's economic development. The study is relevant because it highlights that, in recent years, the interest of large multinational companies in investing in Angola, especially in regions rich in natural resources such as Lundas, Bié, Cabinda, and Huila, has increased. However, these companies raise questions related to access to justice, which is seen as an important guarantee for the security of private investment.
Among the main concerns of the business sector are the efficiency of Angola's courts, access to justice, the effective protection of investors' economic interests, procedural speed, and bureaucracy in the functioning of the judicial system. The article then explores the role of arbitration tribunals as a viable solution to overcome these limitations, offering a more agile and efficient means for resolving commercial and contractual disputes, especially in mining areas, which involve large volumes of investment.
The methodology used is based on documentary and bibliographic analysis, aiming to examine different perspectives from authors and to study the guiding documents created in Angola to regulate the mining sector. The analysis includes both the challenges faced by investors and the proposed solutions to promote a more attractive and secure legal environment for foreign investment in the country.
